Barnett v. Rymanowicz

Plaintiff, a 44-year-old female employed by a dry cleaning firm was visiting the defendant's home when a gun being shown by the defendant fired into a concrete floor. Plaintiff's eye was injured by concrete debris thrown up by the gun shot resulting in several surgeries, the loss of one eye, and subsequent need for a glass eye. Plaintiff's husband also claimed Negligent Infliction of Emotional Distress and Loss of Consortium.

The case was settled for $850,000. A video demand depicting the daily care of the glass eye and allowing the plaintiff's to address the insurance company directly with Ms. Barnett's limitations was key to the result.
