GTLA Case Involves Bush-Hogging Along the Highway - Judgment Totals $189,000

Shipley v. City of Covington, Tennessee, Circuit Court of Tipton County, No. 4663.

At the time of the accident, the plaintiff, a 39-year-old female, was driving a van in which her 13-year-old daughter was a passenger. Plaintiff alleged that the defendant, while bush-hogging along the highway over the crest of a hill, allowed a bat-wing device on the equipment to protrude into heavy traffic causing a collision that flipped her van.

The mother had multiple femur fractures and bruising. Her 13-year-old daughter suffered a broken nose in the accident and suffered from nightmares following the accident. Plaintiff's husband also claims Loss of Consortium.

No monetary amount was ever offered on the case prior to court Judgment, after 15% reduction for Plaintiff's fault, and for GTLA caps, totaled $189,000.
